ERSUMA – OHADA / PUBLICATION OF NUMBER 16 OF THE ERSUMA BULLETIN OF PROFESSIONAL PRACTICE

The Regional Higher School of Magistracy (ERSUMA) of the Organization for the Harmonization of Business Law in Africa (OHADA) hereby notifies you the publication of its 16th and last release of the ERSUMA Bulletin of Professional Practice (BEPP) for the year 2018.
This periodical informs you about the latest developments in business law, whether it is OHADA Law, the National Law of the Member States, other African Community Laws and Comparative Law.

In this release, through the sections on chronicles, case law, national legislation and professional practice, the reader will be able to obtain brief information on topics such as:

  • The express compatibility of OHADA Law for commercial companies with financial market Law: the example of the nominal value of shares of listed companies;
  • The judge in charge of enforcement litigation has no jurisdiction to hear an application for the settlement of penalty payments;
  • The petition for interpretation of a judgment must articulate a proposal for an understanding of the meaning or scope of the operative part of the judgment to be interpreted;
  • The seizure carried out in the presence of the debtor’s employees is not a seizure in the hands of a third party;
  • The fifteen-day time limit for lodging a setting aside against an order for payment is a clear deadline;
  • The issuance by the Registry to the counsel of the parties of the decision “as Certified True Copy” constitutes a notification within the meaning of Article 28(1) of the CCJA Rules of Procedure;
  • The appeal, without specifying its nature to enable the opposing party to usefully prepare its defence and the CCJA to exercise its control, is inadmissible ex officio; and
  • The disparity of the remuneration grid for judicial representatives in collective proceedings for wiping off debts in the OHADA space.
