Availability of the Uniform Act on the Accounting System for Not-for-Profit Entities

Adopted by the OHADA Council of Ministers at its 53rd session held in Niamey (Niger) on the 21st and 22nd of December 2022, the Uniform Act relating to the Accounting System for Not-for-Profit Entities (SYCEBNL) has been published in the Official Journal of the Organisation, in accordance with the Treaty.

This text, which enriches the OHADA’s normative arsenal, is the 11th Uniform Act. It is a useful complement to the Uniform Act of 26 January 2017 on Accounting Law and Financial Reporting (AUDCIF) which, while intended to govern the accounting of all entities involved in the production of market and non-market goods and services, within the framework of activities carried out for profit or not, nevertheless excluded the application of the OHADA accounting system (SYSCOHADA), which is annexed to it, to some entities, including non-profit entities.

An accounting system is annexed to the new legal corpus to which all non-profit entities having their registered office in the territory of an OHADA Member State or carrying out their activities there are subject, unless they are subject to the public accounting system, to the accounting system subject to a special regime or specific national provisions. The financial reporting system it establishes provides, alongside the normal system, for a minimum treasury system for the use of small entities.

In accordance with its final provisions, the new Uniform Act and the accounting system annexed to it shall enter into force on the 1st of January 2024. Its publication should contribute to the assimilation of the new system by the users, before its entry into force.
