Publication of OHADA’s economic impact study

The question of OHADA law’s economic impact has been of constant concern to policy makers, entrepreneurs, researchers and the entire community of OHADA’s friends. Several economic analysis works have been already devoted to this question by the World Bank in the two editions specially dedicated to the OHADA area in 2012 and 2017. An economic impact study limited to three specific Uniform Acts was also conducted in 2018 by the firm ECOPA.

However, the most comprehensive economic impact study was conducted during 2021-2022 by the firm IDEA CONSULT INTERNATIONAL, hired on the basis of an international call for tenders as part of the Investment Climate Improvement Project (ICP) financed by the World Bank Group. The study measures the economic efficiency of OHADA’s contribution to business creation, access to credit, insolvency resolution, investment and growth…Beyond that, it examines the level of the legal effectiveness and uniformity of OHADA law and assesses the adequacy of the Organization’s institutional system.

The study, whose findings were approved by the Council of Ministers of OHADA at its 53rd session held in Niamey on the 21stand 22nd of December 2022, establishes in substance that :

  • OHADA law has an indisputable and positive impact on investment, growth and employment, it also positively impacting business creation and private sector financing in member states;
  • the institutional system is generally coherent and adequate for the Organization’s missions, despite the fact that some bodies encounter specific issues;
  • the legal effectiveness of the Uniform Acts shall be improved, there is also a need to enhance the assimilation of the texts by the professionals.
