ANNOUNCEMENT
The Regional Advanced School of Magistracy (ERSUMA) of the Organisation for the Harmonisation of Business Law in Africa (OHADA) is pleased to announce the release of a special Issue of the ERSUMA Review on the reform of the OHADA simplified recovery procedures and enforcement measures.
Produced under the scientific supervision of Professor Ndiaw DIOUF, University Professor and main editor of the new Uniform Act governing simplified recovery procedures and enforcement measures (AUPSRVE), this special issue includes several contributions, validated by a scientific committee and covering various aspects of the reform.
In this issue, readers will find more than fifteen (15) scientific contributions grouped into four parts as follows:
Common provisions and debt collection law:
- The new Uniform Act to lay down simplified recovery procedures and enforcement measures (AUVE): a chiaroscuro presentation;
- The emergence of a common law on simplified recovery procedures and enforcement measures in the OHADA area.
Simplified recovery procedures:
- The new injunction to pay procedure: between rootedness and openness;
- Innovations in simplified procedures for the restitution or delivery of tangible movable property;
- The recovery of small claims under the revised Uniform Act on simplified procedures and enforcement measures (AUPSRVE).
Enforcement measures:
- The new Article 49 of the Uniform Act on simplified recovery procedures and enforcement measures;
- The various types of daily penalty for delay in payment of debt before the OHADA enforcement judge;
- A critical look at the reform of immunity from execution in OHADA law
- Details on the new face of the judge under Article 49 of the Uniform Act to lay down simplified recovery procedures and enforcement measures;
- The new face of immunity from execution in OHADA law;
- Animals and the new OHADA enforcement procedures;
- Scope of immunity from execution of legal persons governed by public law under OHADA law;
- The new face of enforcement rights for creditors of legal persons governed by public law in the light of the Uniform Act on Simplified Recovery Procedures and Enforcement Measures (AUPSRVE) of 17 October 2023.
National laws and comparative law:
- Reflections of a Cameroonian legal mind on article 49 (new) of the AUPSRVE: does the enforcement judge remain the judge dealing with urgent matters?
- Injunction procedures under the 2023 Uniform Act on Simplified Recovery Procedures and Measures of Execution: what implications for Anglophone Cameroon;
- The new nullities of the Uniform Act on the organization of simplified recovery procedures and enforcement measures (AUPSRVE) of 17 October 2023: a comparative approach with French law.
