OHADA Permanent Secretary Received in Audience by the Prime Minister of Madagascar

Within the framework of the diplomatic mission he is leading in Antananarivo, Capital of the Republic of Madagascar, Prof. Mayatta Ndiaye MBAYE, Permanent Secretary of OHADA, was received in audience on Thursday 5 September 2024 by H.E. Mr Christian NTSAY, Prime Minister of the Republic of Madagascar, in the presence of Mr Alexis Benjamin RAKOTOMANDIMBY, Keeper of the Seals, Minister of Justice. Organisations representing the private sector were represented at this meeting by Ms ANDRIAMAMONJIARISON, Honorary President of the Groupement des Entreprises de Madagascar (GEM) and Mr Tiana RASAMIMANANA, President of the Syndicat des Industries de Madagascar (SIM).

During these discussions, the Permanent Secretary presented the advantages and opportunities offered by the OHADA system for improving the business climate and boosting the private sector. The Head of Government of Madagascar took note of the unanimous wish expressed by the organisations representing the private sector in favour of the country joining OHADA. He also committed himself to continuing to reflect on the implications of this membership.

On the sidelines of this high-level meeting, the Permanent Secretary is taking part in an exchange workshop organised by UNIDA, ACP Legal Océan Indien and the Malagasy Consortium for OHADA, comprising GEM, SIM and FIVMPAMA. Work began on 3 September and will continue until 6 September 2024. This forum will enable some forty professionals from all walks of life (judges, lawyers, notaries public, bankers, corporate lawyers, representatives of the Arbitration Centre of Madagascar, representatives of the Ministries of Industry, Commerce and Justice) to exchange views over four days on the law of securities, general commercial law, company law and alternative dispute resolution, from a comparative perspective between OHADA law and Malagasy law. The discussions on each topic will be co-hosted by Madagascan experts and the OHADA team, which includes the Permanent Secretary, the Director General of ERSUMA and the Director of Legal Affairs, Documentation and Communication.
