New normative areas

By Decision No. 0011/2011 / CM / OHADA of 17 June 2011, as amended by Decision No. 02/2013 / CM / OHADA of 14 June 2013, the Council of Ministers instructed the Permanent Secretary to conduct studies assessing the feasibility and timeliness of extending OHADA law to the following subjects: factoring, leasing, franchising, subcontracting, joint venture, mediation, public-private partnership contracts, conflict of laws regulation and circulation of public documents.

Furthermore, the Conference of Heads of State and Government held in Ouagadougou (Burkina Faso) on 13 October 2013, prescribed the enactment of Uniform Acts in the new subjects above-listed.

Pursuant to these high instructions of Heads of State and Government, the Permanent Secretariat commissioned studies, the reports of which were transmitted to the Member States. These studies have already led to the drafting of a Uniform Act on Mediation, adopted by the Council of Ministers at its 45th session in Conakry (Guinea) on 23 and 24 November 2017. The process is on course with the imminent launching of the new reform on factoring.
